Avery Grosse

“Avery Grosse is a very old principle, perhaps as old as shipping itself” During transport the goods transported are exposed to all kinds of dangers such as theft, fire, explosion, spoilage, contamination, (traffic)accidents, sink, and stranding. Avery Grosse is governed by Article 1022 of Book 8 of the (Dutch) Civil Code. It is an old principle whereby all parties involved in a sea voyage, ie ship, cargo and freight, proportionally share the losses that are a result of a voluntary and successful sacrifice. This sacrifice is a part of the ship and / or the load to protect the entire enterprise against an imminent danger.

The cargo owners (you) may also be held liable by the owner (owner) of the vessel (shipping line) to contribute to costs incurred to protect the common interest. These costs can be the result of a cargo ship ending up in an emergency where the owner must make special (additional) costs to allow the ship arrive safely at their destination. These could include towing costs, emergency repairs, etc. Since the ship must incur costs to ensure ship and cargo, all stakeholders contribute to the payment of these costs.

When there is a general average situation? An emergency involving vessel, cargo and crew are involved; a menacing and apparently “unavoidable” danger that can be avoided only by intentionally causing damage to the ship and / or cargo. This attempt in order to avoid the imminent common danger will ultimately have to be successful. To determine the Avery Grosse cost contribution an average adjuster is appointed and this person will determine the contributions on a proportional basis of the carrying values of the “rescued” ship and cargo. It can take up to several years to establish the final costs per cargo owner. During this period, insurance companies involved will guarantee an Avery Grosse issue to guarantee the payment of the final Avery Grosse contribution (s).
